Municipal Inspection Agency
Article 59.º.
Mission
The Municipal Inspection Agency is a municipal service that, under the guidance of the President of the Municipal Authority, and without prejudice to the specific powers of other bodies and services, is responsible for ensuring the implementation of inspections and audits for the organization and functioning of Local Administration Bodies and services.
Article 60.o.
Tasks
The functions of the Municipal Inspection Agency are as follows:
a) Programming, planning, and executing inspections and audits of Local Government bodies and services;
b) Identify situations of non-compliance with the current legal framework, irregular functioning of Local Government bodies or services, or misuse of public resources;
c) Prepare final reports on inspections or audits;
d) Study, develop, and present to the President of the Municipal Authority the proposed Municipal Plan for the Prevention and Combating of Corruption;
e) Propose to the President of the Municipal Authority the necessary measures to promote compliance with the current legal framework, to normalize the operations of the bodies or services audited or inspected, and to adopt best practices in the management of administrative, financial, assets, and public human resources;
f) To inform the President of the Municipal Authority of acts that may constitute criminal offenses and the identity of those responsible;
g) To inform the President of the Municipal Authority of acts that may constitute financial violations and the identity of their responsibilities;
h) To inform the President of the Municipal Authority of acts that may constitute disciplinary infractions and the identity of those responsible;
i) Submit to the member of the Government responsible for State Administration reports imputed to the President of the Municipal Authority on the practice of acts constituting criminal, financial, or disciplinary offences;
j) Monitor the implementation of measures recommended by the Municipal Supervision Agency itself to promote compliance with the current legal framework, to standardize the functioning of agencies or services audited or inspected, and to adopt good practices in administration, financial, asset and human resource management, and evaluate the results obtained;
k) Prepare opinions on the implementation report of the Municipal Budget, particularly on the legality of financial transactions carried out and the efficient use of public financial resources made available to the Municipal Authority;
l) Certify the balance in the bank account of the Municipal Authority on the last working day of each calendar year;
m) Perform other duties related to the supervision and audit of services, when considered necessary, assigned by superiors, and not assigned to other bodies or services of the Municipal Authority.
