Municipal Water, Sanitation, and Environmental Services

Article 38.º.

Mission

The Municipal Water, Sanitation and Environment Service is a service of the Municipal Authority that, under the guidance of the President of the Municipal Authority, is responsible for ensuring the application of legislation and the execution of public policies and government programs in the areas of water supply, domestic wastewater drainage, and urban waste collection, treatment and management.

Article 39.º.

Tasks

The Municipal Water, Sanitation and Environmental Services is responsible for:

a) Propose to the President of the Municipal Authority the opening of the procurement procedure for the execution of works and for the supply of goods necessary for the construction, maintenance, or improvement of water supply systems for population centers, drainage systems and treatment of domestic wastewater in population centers, collection systems, garbage collection and urban solid, and public sanitary facilities and bathrooms;

c) Periodically inspect the operation of water supply systems for population centers, drainage and treatment systems for domestic wastewater in population centers, and urban solid waste collection, management, and disposal systems;

d) Collaborate with the Municipal Food Security Service to conduct periodic analysis of water distributed from public water supply systems to population centers;

e) Propose to the President of the Municipal Authority the necessary administrative measures to protect the sources and distribution network of water for human consumption;

(f) Identify the damaged pumping stations, transmission pipes, valves, and tanks of the water supply system and arrange for repairs, in accordance with points a) and b);

g) Manage public toilets and changing rooms;

h) Carry out actions to eradicate rats in drainage and wastewater treatment systems and control mosquitoes in wetland areas;

i) Study, develop, and submit for approval to the President of the Municipal Authority the municipal system for disposal, collection, transportation, treatment, and final disposal of solid waste;

j) Manage the system for the deposition, collection, transportation, treatment, and final disposal of urban solid waste;

k) Propose to the President of the Municipal Authority the opening of a procurement procedure for the provision of the necessary equipment for the elimination, collection, transport, treatment, and final disposal of urban solid waste;

l) Collaborate with the Municipal Procurement Service to prepare technical specifications that must be included in the procurement procedure document for the award of public contracts for the supply of goods necessary for the disposal, collection, transportation, treatment, and final disposal of urban solid waste;

(m) Define disposal sites, circuits, and schedules for the collection and transportation of urban solid waste;

n) Distribute, in all designated places, receptacles for the disposal of urban solid waste, especially garbage cans, bins, and bins, and ensure their maintenance and replacement, when necessary;

o) Ensure the cleaning, disinfection, and disinfection of public places in urban areas and take the necessary actions to prevent and combat epidemics;

p) Ensure cleaning and disinfection of beach sand and periodic analysis of water quality in the bathing area near wastewater discharge points;

q) Conduct regular roundups of stray animals in urban areas;

r) Propose to the President of the Municipal Authority to initiate procurement procedures for the construction, maintenance, or improvement of parks and gardens in urban areas;

s) Collaborate with the Municipal Procurement Service to prepare technical specifications to be included in the procurement procedure documents for the award of public contracts for the acquisition of goods or the execution of works for the construction, conservation, or repair of parks and gardens in population centers;

t) Ensure the cleanliness of existing parks and gardens in population centers, as well as the cleanliness of public equipment and infrastructure located there;

u) Ensure the planting of trees and shrubs in population centers, as well as their maintenance;

v) Cutting down existing trees and shrubs in population centers;

w) Inspect existing trees and shrubs in population centers, to identify those that may pose a risk to public health or safety;

x) Ensure the management of suco funds for urban cleaning, in accordance with respective regulations; y) Identify those responsible for violating the prohibitions set out in paragraphs a), b), c), and d) of No. 1 of Article 5, paragraphs a), b), c), and d) of No. 1 of Article 6, paragraphs a), e), g), and h) of No. 2, both of Article 6, and article 8, all of Decree-Law No. 33/2008 of 27 August, elaborate the respective reports and promote the terms of the administrative infringement process that follow them;

z) Perform other duties in the field of water, sanitation and environment that are necessary for the performance of the responsibilities of the Municipal Authority assigned to it by the higher authority and that are not the responsibility of other bodies or services of the Municipal Authority.

Article 40.º.

Department

 

1. Municipal Water, Sanitation and Environmental Services include:

a) A Planning and Development Department of the Public Water Supply and Basic Sanitation Network, responsible for carrying out the acts and processing the administrative processes necessary for the performance of the tasks provided for in items a), b), f), and z) of the preceding article;

b) A Basic Water and Sanitation Network Management and Control Department, responsible for carrying out acts and the processing of administrative processes necessary for the performance of the tasks provided for in articles c), d), e), g), h), and z of the preceding article);

c) An Environmental Department, responsible for carrying out the acts and processing the administrative procedures necessary to carry out the tasks provided for in points i), j), k), l), m), n), o), p), q), r), s), t), v), w), x), y), and z).

2. The departments provided for in the preceding paragraph shall be headed by the Heads of Departments, appointed according to the arrangement of deployment, in accordance with Decree-Law No. 3/2016 of 16 Marc
