Municipal Procurament Services

Article 16

Mission

The Municipal Procurement Service is a service of the Municipal Authority whose mission is to provide technical and administrative support to the President of the Municipal Authority and to other organs and services of the Municipal Authority in the areas of opening, conducting and monitoring procurement procedures.

Article 17.º.

Tasks

The duties of the Municipal Supply Service are:

a) Open, instruct and develop supply procedures, in accordance with the current legal framework, in accordance with the municipal supply plan and in accordance with guidelines issued by the competent administrative entities;

b) Create and maintain up-to-date complete records of all supply procedures carried out;

c) Refuse to open procurement procedures that are not provided for in the Municipal Procurement Plan, without prior authorization from the President of the Municipal Authority or whose value exceeds the scope of the President of the Municipal Authority;

d) Prepare a draft public contract to be signed by the President of the Municipal Authority, who represents the State;

e) Monitor the execution of public contracts signed by the President of the Municipal Authority and inform superiors about any situation of compliance defects or non-compliance that they know;

f) To give an opinion on the conformity of works, goods and services carried out according to the public contract signed by the President of the Municipal Authority with the technical specifications contained in the documents that provide instructions for the procurement procedure;

g) Perform other duties in the field of procurement that are given to them by superiors and that are not the responsibility of other bodies or services of the respective Municipal Authority.

Article 18.º

Departments

  1. Municipal Supply Services include:

a) The Procurement Process Department, responsible for carrying out the acts and processing the administrative processes necessary for the exercise of the tasks provided for in paragraphs a), b), c) and g) of the preceding article;

b) A Public Contract Execution Monitoring Department, responsible for carrying out the acts and processing the administrative processes necessary for the exercise of the tasks provided for in paragraphs d), e), f) and g) of the preceding article.

2. The departments provided for in the preceding paragraph shall be headed by Heads of Departments, appointed according to the regime of the service commission, in accordance with the terms of Decree-Law No. 3/2016, dated 16 March.
