Municipal Food Safety Service
Article 32.o.
Mission
The Municipal Food Security Service is a service of the Municipal Authority that, under the guidance of the President of the Municipal Authority, has the mission to ensure the application of legislation and the execution of public policies and government programs in the field of food security and nutrition in the municipality.
Article 33.o.
Tasks
Municipal Department of Food Safety duties include:
a) To study, develop and implement an information strategy public information on good practices for handling, preparing, manufacturing and selling food products for human consumption;
b) Conduct workshops and information sessions aimed at the general public and economic agents, especially on good practices in the handling, preparation, manufacture and sale of food products for human consumption;
c) Produce guidelines and manuals on good practices for the production, processing, handling and sale of agri-food products intended for human consumption, for economic agents in the agri-food sector;
d) Conduct workshops and information sessions aimed at economic agents in the agro-food sector to disseminate good practices in the production, processing, handling and sale of agro-food products intended for human consumption;
e) Inspect the hygienic and health conditions of places or establishments where food products are stored, manufactured or sold for human consumption and inform those responsible for these places of the measures they must adopt to eliminate or mitigate identified risk factors for human health or environmental health;
f) Conduct inspections of the hygienic and health conditions of food storage facilities intended for human consumption, through cafeterias of educational establishments or in the framework of the “school meal” program; g) Conduct inspections of the hygiene and health conditions of the cafeteria of the educational establishment or of the place of food consumption distributed within the framework of the “school meal” program;
h) Promote the performance of periodic bacteriological analyzes of the quality of water distributed through public and bottled water supply systems and notify those responsible of measures to be adopted to eliminate or mitigate risk factors for human health;
i) Propose to the President of the Municipal Authority or to the Municipal Administrator a communication to the Authority for the Inspection and Monitoring of Economic, Sanitary and Food Activities responsible for the processing and application of sanctions, on the facts that, in the exercise of its respective powers, the Municipal Secretariat may violate the public and constitutional food supply;
j) Perform other duties in the area of food safety that prove necessary for the performance of powers vested in the Municipal Authority determined by superiors and that are not the responsibility of other bodies or services of the Municipal Authority.
Article 34.º.
Departments
1. The Municipal Food Safety Service includes:
a) A Food Safety Information and Promotion Department, responsible for carrying out acts and processing administrative procedures necessary for the exercise of the tasks provided for in paragraphs a), b), c), d) and j) of the preceding article;
b) A Food Safety Monitoring Department, responsible for carrying out the acts and processing the administrative procedures necessary for the exercise of the tasks provided for in paragraphs e), f), g), h), i) and j) of the preceding article.
2. The departments provided for in the preceding paragraph shall be headed by Heads of Departments, appointed according to the arrangement of posting, in accordance with the terms of Decree-Law No. 3/2016, of 16 March.
